You may be able to apply for Indefinite Leave To Remain in the UK or UK Residency visa after 4 years continuous stay in the UK provided you meet the qualifying conditions for the Indefinite Leave To Remain – ILR.
To qualify for ILR you should have continuously been living in the UK for four years without any break of stay for more then 3 months continuously. Also, you should not be away from the UK for more than 6 months in total during this qualifying period of 4 years stay.
You should not have taken any help from UK Public Fund or any Social Security Support and you should be economically active in the UK and should be able to take care of accommodation for you and your dependants without recourse to UK Public Funds. If you are in the UK under HSMP which was applied before 3 April 2006 and have completed 4 years continuous stay already or would be completing 4 years continuous stay in the UK, you may be eligible to apply for Indefinite Leave To Remain in the UK as per the recent court judgement on Judicial Review application filed by HSMP Forum Ltd. Home Office is yet to announce its policy document on how they would implement the court decision and hence it would be advisable to bookmark this page and you should visit this page and site regularly for updates on the matter.
